Copyright and takedown policy
Survey Tracker stores photos, notes and reports that our customers and their surveyors upload. We respect copyright and respond to notices of claimed infringement under the US Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws elsewhere.
Designated copyright agent
Our agent registration with the US Copyright Office is pending. Agent contact details will be published here once it is complete.
Sending a notice
Send a written notice to the agent above that includes:
- Your physical or electronic signature.
- The copyrighted work you say has been infringed.
- The material you want removed, with enough detail for us to find it (a link or the survey and photo it appears in).
- Your name, address, phone number and email.
- A statement that you believe in good faith the use isn't authorised by the copyright owner, its agent or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for them.
We remove or disable access to the material promptly and tell the user who uploaded it.
Counter-notices
If you think your material was removed by mistake, send a counter-notice to the agent that includes:
- Your physical or electronic signature.
- The material that was removed and where it appeared before.
- A statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and phone number, and that you consent to the jurisdiction of the federal court for your address (or, outside the US, any district where we may be found) and will accept service from the person who sent the notice.
We forward valid counter-notices to the person who complained. Unless they tell us within 10 business days that they have started court action, we restore the material 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We close the accounts of users who repeatedly infringe copyright, in appropriate circumstances.
Knowingly misrepresenting that material is infringing, or was removed by mistake, can make you liable for damages.
